Deletion Requests and Opt-Outs
At Scriptcycle, we strive to go above and beyond both legal requirements and consumer expectations when it comes to protecting your data. As part of our commitment, all users nationwide can request deletion of their data as specified in the California Consumer Privacy Act. You can submit a request by visiting https://www.goodrx.com/requestdeletion. Please note that we will need to verify your request before we can fulfill it, including verifying your identity.
The Scriptcycle website has implemented Google Analytics Demographics and Interest reporting. This tool requires that we permit access to cookie identification information and enables us to view demographic and other information aggregated from the overall population of the visitors to our site. The information we receive does not include your name or contact information.
By using this website, you agree to let us use such personal information in order to provide services to you, to run our business (including for the purposes of internal business operations and analytics, to provide, change, market or optimize our services and products) and to communicate and market to you (directly or via third parties).
Children’s Online Privacy Protection Act (“COPPA”)
Our Site is not directed to children under the age of 13. We assume our website is used by adults or minors supervised by a parent or guardian. We respect the privacy of parents and children and are committed to complying with the Children's Online Privacy Protection Act ("COPPA"). On those areas of our Site that ask for age, we do not collect personal information from individuals who identify themselves as under the age of 13 except in those limited circumstances where we believe that such collection is permitted under COPPA.
We may ask prospective users to provide their age during the registration process and on other areas of our Site. If a user indicates that he or she is under the age of 13 then all personal data collected during the registration process is automatically deleted except that we may retain and use limited information, such as the child's email address, for a limited period of time, in those cases where we believe that the collection and use of such information is permitted under COPPA.
If a parent believes that his or her child has provided us with personal information, he or she can contact us via email or postal mail as listed below. We will promptly delete the information upon learning that it relates to a child under the age of 13.
We believe that parents should supervise their children's online activities and consider using parental control tools available from online services and software manufacturers that help provide a kid-friendly online environment. These tools can also prevent children from otherwise disclosing online their name, address and other personal information without parental permission.

Personal Information We May Collect
The following chart shows the categories of personal information that we have collected during the past 12 months, the sources of the information, our purposes/uses of the information, and whether we disclose the information for a business purpose. In the “Sale” of information under CCPA section, we separately describe the commercial purposes for use of personal information.
As a summary, we generally use personal information for the following business purposes.
General Business Operations. We use personal information for our general business operations, such as order fulfillment, customer support, payment processing, and related actions for provision and maintenance of our services. For instance, we may check the price that you receive at the pharmacy against the price that we displayed to you on the website to ensure pricing accuracy. We also may transfer personal information in the context of a merger, acquisition, reorganization, or similar event, such as to a third party that acquire all or substantially all of the assets or stock of Scriptcycle.
Optimize Services. We use personal information to our services and products, such as through our use of analytics. To continue the example provided in the paragraph above, if we see that multiple people are not receiving the displayed website price at the pharmacy, we may stop showing that price while we reach out to the pharmacy or our other partners to figure out why the price is incorrect.
Communication and Marketing. We use personal information to communicate and market to you. For instance, we may send you refill reminders for your prescription, an updated coupon with a better price, or information about a service that we believe you may be interested in.
Auditing Interactions. We use personal information to audit our interactions with you, for instance counting ad impressions (e.g., whether you’ve seen our ads or not), detecting security incidents, protecting against fraud or other malicious activity; and identifying and repairing errors that may arise.
Compliance With Law. We use personal information for compliance with law, court orders, government regulations, and responding to law enforcement requests.
For the table below, the list of examples for each category is intended to be illustrative and not exhaustive. We also may not collect or disclose every example listed (or use every example for each business purpose).

Rights under CCPA
As of January 1, 2020, California residents will have the right:
In order to make a request for access or deletion you may contact us by phone at the toll-free number +1 (888) 328-8544.
In the case of access and deletion, your request must be verifiable before we can fulfill such request. We will ask you or your authorized agent for information that allows us to reasonably verify your identity (that you are the person about whom we collected personal information) and the authorized agent’s identity, respectively. We will only produce prescription-specific data if you can provide us with the related BIN, PCN, group number, and member ID, due to the sensitivity of that information.
“Sale” of information under CCPA / Cookies and Pixels
We do not “sell” your personal information to third parties in exchange for payment. We do use pixel tags and similar technologies from third-party adtech providers to disclose identifiers (e.g., IP address, cookie IDs), internet/electronic activity, and geolocation data for advertising and analytics purposes and we have done so in the previous 12-month period.
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of the Web page.
While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

This Agreement was last updated December 4, 2020.
1. Contractual Relationship
If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. Scriptcycle may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason, except where prohibited
IMPORTANT: PLEASE REVIEW THE ARBITRATION AGREEMENT SET FORTH BELOW CAREFULLY, AS IT WILL REQUIRE YOU TO RESOLVE DISPUTES WITH SCRIPTCYCLE ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION. BY ENTERING THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION.
If your use of the Services is terminated for any reason, then: (a) these Terms will continue to apply and be binding upon you in respect of your prior use of the Services (and any unauthorized further use of the Services), including your indemnification obligations; and (b) any rights or licenses granted to us under these Terms will survive such termination.
Scriptcycle may amend the Terms from time to time. Amendments will be effective upon Scriptcycle's posting of such updated Terms at this location or in the amended policies or supplemental terms on the applicable Service(s). Your continued access or use of the Services after such posting confirms your consent to be bound by the Terms, as amended.
2. Arbitration Agreement
By agreeing to the Terms, you agree that you are required to resolve any claim that you may have against Scriptcycle on an individual basis in arbitration, as set forth in this Arbitration Agreement. This will preclude you from bringing any class, collective, or representative action against Scriptcycle, and also preclude you from participating in or recovering relief under any current or future class, collective, consolidated, or representative action brought against Scriptcycle by someone else.
Agreement to Binding Arbitration Between You and Scriptcycle.
You and Scriptcycle agree that any dispute, claim or controversy arising out of or relating to (a) these Terms or the existence, breach, termination, enforcement, interpretation or validity thereof, or (b) your access to or use of the Services at any time, whether before or after the date you agreed to the Terms, will be settled by binding arbitration between you and Scriptcycle, and not in a court of law. For the avoidance of doubt, the scope of arbitration includes federal and state statutory and common law claims, including under the consumer protection laws and principles.
You acknowledge and agree that you and Scriptcycle are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Unless both you and Scriptcycle otherwise agree in writing, any arbitration will be conducted only on an individual basis and not in a class, collective, consolidated, or representative proceeding. However, you and Scriptcycle each retain the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.
Rules and Governing Law.
The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the AAA’s Consumer Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the “AAA Rules”) then in effect, except as modified by this Arbitration Agreement. The AAA Rules are available at www.adr.org or by calling the AAA at 1-800-778-7879.
The parties agree that the arbitrator (“Arbitrator”), and not any federal, state, or local court or agency, shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability or formation of this Arbitration Agreement, including any claim that all or any part of this Arbitration Agreement is void or voidable. The Arbitrator shall also be responsible for determining all threshold arbitrability issues, including issues relating to whether the Terms are unconscionable or illusory and any defense to arbitration, including waiver, delay, laches, or estoppel.
Notwithstanding any choice of law or other provision in the Terms, the parties agree and acknowledge that this Arbitration Agreement evidences a transaction involving interstate commerce and that the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (“FAA”), will govern its interpretation and enforcement and proceedings pursuant thereto. It is the intent of the parties that the FAA and AAA Rules shall preempt all state laws to the fullest extent permitted by law. If the FAA and AAA Rules are found to not apply to any issue that arises under this Arbitration Agreement or the enforcement thereof, then that issue shall be resolved under the laws of the state of California.
A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. (The AAA provides a form Demand for Arbitration - Consumer Arbitration Rules at www.adr.org or by calling the AAA at 1-800-778-7879). The Arbitrator will be either (1) a retired judge or (2) an attorney specifically licensed to practice law in the state of California and will be selected by the parties from the AAA's roster of consumer dispute arbitrators. If the parties are unable to agree upon an Arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the Arbitrator in accordance with the AAA Rules.
Location and Procedure.
Unless you and Scriptcycle otherwise agree, the arbitration will be conducted in the county where you reside. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of documents you and Scriptcycle submit to the Arbitrator, unless you request a hearing or the Arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the Arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.
The Arbitrator will render an award within the time frame specified in the AAA Rules. Judgment on the arbitration award may be entered in any court having competent jurisdiction to do so. The Arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant's individual claim. An Arbitrator’s decision shall be final and binding on all parties. If you prevail in arbitration you will be entitled to an award of attorneys' fees and expenses, to the extent provided under applicable law.
Scriptcycle will not seek, and hereby waives all rights Scriptcycle may have under applicable law to recover attorneys' fees and expenses if Scriptcycle prevails in arbitration.
Your responsibility to pay any AAA filing, administrative and arbitrator fees will be solely as set forth in the AAA Rules. However, if your claim for damages does not exceed $75,000, Scriptcycle will pay all such fees, unless the Arbitrator finds that either the substance of your claim or the relief sought in your Demand for Arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).
Severability and Survival.
If any portion of this Arbitration Agreement is found to be unenforceable or unlawful for any reason, (1) the unenforceable or unlawful provision shall be severed from these Terms; (2) severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of the Arbitration Agreement or the parties’ ability to compel arbitration of any remaining claims on an individual basis pursuant to the Arbitration Agreement; and (3) to the extent that any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration.
3. The Services
Prescription discounts and coupons.
Scriptcycle offers prescription discounts and coupons, and prescription pricing information. The prescription discounts and coupons offered via Scriptcycle.com are free.
Scriptcycle prescription discounts and coupons are not insurance. Scriptcycle prescription discounts and coupons can be used instead of, but not in conjunction with insurance. Scriptcycle prescription discounts and coupons are not intended as a substitute for health insurance. The range of the discounts will vary depending on the prescription drug and the participating pharmacy. You are required to pay for all prescription drugs at the time of purchase. Scriptcycle does not make payments to any pharmacy or health care provider. SCRIPTCYCLE PRESCRIPTION DISCOUNTS AND COUPONS DO NOT MEET MINIMUM CREDITABLE COVERAGE REQUIREMENTS UNDER STATE HEALTHCARE COVERAGE REGULATIONS.
Please note that cash payments that you make for medications using Scriptcycle prescription discounts and coupons may not count toward your prescription drug coverage out of pocket costs, but you can confirm that by contacting your coverage provider. If you are a Medicare Part D beneficiary, then cash payments made using Scriptcycle prescription discounts and coupons will not count toward your Medicare Part D cost-sharing obligation. Scriptcycle cannot be combined with federal or state-funded programs like Medicare or Medicaid.
Scriptcycle prescription discounts, coupons and prices shown are based on multiple sources, including published price lists, purchases, claims records, and data provided by pharmacies. Scriptcycle prescription discounts, coupons and prices may change at any time. The prices we show are our best estimate; while we believe our data to be generally accurate, we cannot guarantee that the price we display will exactly match the price you receive at the participating pharmacy. For an exact price, please contact the participating pharmacy. Scriptcycle prescription discounts, coupons and prices may change at any time.
Access to Information.
Most prescriptions purchased in the Unites States, including prescriptions filled through the use of discount coupons, loyalty cards or insurance co-pays, result in the pharmacy reporting patient data back to the company that provides the benefit (“Claims Data”). Scriptcycle uses and stores this Claims Data linked to the information you provide when using the Services (including without limitation your name, email address, prescription names and your address) to provide you with targeted coupons and discounts on prescriptions through your Account.
You agree to fully and carefully read all provided product information and labels and to contact a physician or pharmacist if you have any questions regarding the prescription. Scriptcycle fully honors patient freedom of choice, and if you receive a prescription for a medication, you always have the option to instruct Scriptcycle to transmit that prescription to the pharmacy of your choice.

Choice of Law.
These Terms are governed by and construed in accordance with the laws of the State of California, U.S.A., without giving effect to any conflict of law principles, except as may be otherwise provided in the Arbitration Agreement above or in supplemental terms applicable to your region. However, the choice of law provision regarding the interpretation of these Terms is not intended to create any other substantive right to non-Californians to assert claims under California law whether that be by statute, common law, or otherwise. These provisions, and except as otherwise provided in Section 2 of these Terms, are only intended to specify the use of California law to interpret these Terms and the forum for disputes asserting a breach of these Terms, and these provisions shall not be interpreted as generally extending California law to you if you do not otherwise reside in California. The foregoing choice of law and forum selection provisions do not apply to the arbitration clause in Section 2 or to any arbitrable disputes as defined therein. Instead, as described in Section 2, the Federal Arbitration Act shall apply to any such disputes.
